Thighbanz® Giveaway Rules OFFICIAL SWEEPSTAKES RULES AND CONDITIONS NO PURCHASE NECESSARY. THE SWEEPSTAKES IS OPEN ONLY TO LEGAL UNITED STATES RESIDENTS AND HAVE INTERNET ACCESS PRIOR TO THE START DATE OF THE SWEEPSTAKES. All rights reserved. 3. SWEEPSTAKES PERIOD: The Sweepstakes begins at 8:00 PM (PST) on March 12th, 2007, and ends at 8pm(PST) on March 30th, 2007 (the "Sweepstakes Period"). All entries must be received by 7pm(PST) on March 30th, 2007. 4. HOW TO ENTER: To enter the Sweepstakes, submit an Official Sweepstakes Entry Form (“Entry Form”) via e-mail to info@thighbanz.com. An Official Sweepstakes Entry Form will include your guess matching the celebrity name with the corresponding lettered photo, your full name, complete home address, including zip code, phone number and email address. There is a limit of one (1) entry per email address, per person and/or per family or household. Any duplicate entries, after the first entry, will be void. Alternate Means of Entry: You can also enter the by sending a self addressed stamped envelope to “Thighbanz®: Guess Those Thighs” Giveaway, c/o Thighbanz® Inc. 9854 National Blvd. LA, Ca. 90034. Be sure to include a valid email address with your entry! No purchase is necessary to enter! All entrants agree to abide by these Official Rules. When you register for the Sweepstakes, Organizing Sponsor will collect your personal information and store it for the purpose of contacting you in the future about new promotions and campaigns. Organizing Sponsor will not disclose your personal information to any third parties. If you do not want to receive communications from Organizing Sponsor, please send a request to remove your name from the mailing lists to: Thighbanz® Inc. 9854 National Blvd. LA, Ca. 90034 . The first and last name provided by entrants will be the identity of the entrant and, if selected and qualified for a prize, the identity of the winner. The winner must provide Organizing Sponsor with proof that the winner is the authorized account holder of the e-mail address associated with the winning entry. The use of a bogus name or e-mail address will disqualify an entrant. All entries become the property of Organizing Sponsor. In the event of a dispute, the "entrant" for online entries is the person in whose name the online account is held. Organizing Sponsor is not responsible for lost, late, partial, incomplete, or garbled computer transmissions, or for technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware, or software which may limit an entrant's ability to participate in this Sweepstakes. Proof of sending will not be deemed to be proof of receipt. 5. WINNERS: One (1) winner will be selected on a first come, first serve basis on April 6th, 2007 from all eligible entries received by Organizing Sponsor by 7pm(PST) on March 30th, 2007. The odds of winning depend on the total number of eligible entries received. The administration of the Sweepstakes and the drawing will be overseen by Organizing Sponsor, whose decisions are final and binding in all respects related to the administration of the Sweepstakes and the selection of potential winners. Organizing Sponsor reserves the right to verify eligibility qualifications the winners. 6. PRIZE: The “Prize” consists of one pair of Thighbanz® (the “Prize”). The odds of winning depend on the total number of eligible entries received. The total retail value of the Prize is between $19.99 and $29.99. 7. NOTIFICATION OF WINNER. A representative of Organizing Sponsor will notify a potential winner (the “Winner”) by e-mail only. The potential winner will be given fifteen (15) calendar days from the first time/day of notification to respond to Organizing Sponsor by e-mail, in order to claim his/her prize. If the potential winner has not responded to Organizing Sponsor within the specified fifteen (15) day period, the potential winner will be disqualified and an alternate will be selected from the pool of eligible entries. If an entrant is found to be ineligible, he/she will be disqualified and an alternate winner will be selected from the pool of eligible entries. The Prize is non-transferable and must be accepted as awarded. No cash alternative or other substitution allowed. Except where prohibited by law, participation in the Sweepstakes shall constitute an entrant's consent to be bound by these Official Rules and to conform to all federal, state and local laws. Organizing Sponsor reserves the right, in their sole discretion, to substitute a prize of equal or greater value, whether in cash or otherwise, if the prize cannot be awarded as described for any reason. Potential winners may be required to furnish proof of identity, address and birth date in order to receive the prize. All taxes on prizes and incidental expenses associated with claiming the prize are the sole responsibility of the Winner. The Winner agrees that the prize is “AS IS” and “WITHOUT WARRANTY” except for any warranty that is expressly provided by the manufacturer or supplier of the prize, and each winner is subject to all restrictions imposed by the manufacturer or supplier of the prize. Organizing Sponsor has not made and/or are not responsible for any representation or warranty, express or implied, relative to the Prize. Each eligible winner will receive his or her Prize within six (6) weeks after he or she claims his or her prize. 8. DISQUALIFICATION. All Official Rules must be complied with and all required releases must be provided or the Winner will be disqualified and the Prize will be forfeited and awarded to the alternate winner. Organizing Sponsor reserves the right to request valid identification and/or proof of age from the Winner. Failure to present such identification, driver’s license or proof of age will result in disqualification of the Winner and forfeit of the prize, and the prize will be awarded to the alternate winner. Organizing Sponsor, in its sole discretion, reserves the right to disqualify any individual who attempts to undermine the legitimate operation of the Sweepstakes by tampering with any web site mechanism, acts in a disruptive manner or violates these Official Rules. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION OF SUCH ENTRANT. SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. Organizing Sponsor may prohibit you from participating in the Sweepstakes if at their sole discretion you show a disregard for these Official Rules or act in an unsportsmanlike manner, with intent to annoy, abuse, threaten, or harass any other person, or in any other disruptive manner. 9. RELEASES. Before receipt of the Prize, the Winner may be required to execute a written affidavit of eligibility and a liability release and, where lawful, a publicity release in favor of Organizing Sponsor, all of which must be signed, notarized and returned within fifteen (15) days of date of notification. The Winner agrees to give his/her written consent for use of his/her name, city, state, province or county, and country, likeness, photograph, statements made by the Winner about the Sweepstakes, the Organizing Sponsor, and/or prize information for promotional and advertising purposes without further payment or consideration. 10. LIMITATION OF LIABILITY. Organizing Sponsor excludes all liability for any personal injury, loss, or damage of whatever kind (including loss of data) caused directly or indirectly, in whole or in part, from downloading any material from Organizing Sponsor’s web site, regardless of whether the material was prepared by Organizing Sponsor or a third party, and regardless of whether the material is connected to Organizing Sponsor’s web site by a hypertext link. Organizing Sponsor takes no responsibility for the content of third party web sites which may be linked to Organizing Sponsor’s web site by a hypertext link. Organizing Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, technical failures, or any other factor beyond Organizing Sponsor’s reasonable control impairs the integrity of the Sweepstakes as determined by Organizing Sponsor in its sole discretion. In the event of such impairment, Organizing Sponsor may choose potential winners from all eligible entries received as of the time of impairment. By receipt of any prize in the Sweepstakes, the Winner agrees to release and hold harmless Organizing Sponsor, and its affiliates, directors, officers, employees and agents from any liability for damage, injury, death, loss, cancellation or other liability arising from the Winner's acceptance or use of any prize or substitute prize or their participation in this Sweepstakes, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy or from any misuse or malfunction of such prize or substitute prize. Nothing in these rules shall be taken to exclude any liability for death or personal injury caused by the negligence of Organizing Sponsor. Organizing Sponsor and its affiliates, directors, officers, employees and agents assume no liability for losses incurred as a result of cancellation of the Sweepstakes or for any reason whatsoever or through the acts or defaults of any company or person providing any prize or for events occurring after the award of such prize. All such losses or expenses will have to be borne by the individual Sweepstakes winner. The Sweepstakes is subject to all federal, state and local laws and may be void where prohibited by the law of the entrant's place of residence. 11. INTERNET. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of Organizing Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Organizing Sponsor reserves the right at its sole discretion to disqualify any individual (and his Sweepstakes entry) who tampers with the entry process, and to cancel, terminate, modify, or suspend the Sweepstakes or the Internet/e-mail/electronic forms portion of the Sweepstakes and void such entries, and Organizing Sponsor will select winners solely from among eligible entries received up to that time. 12. GOVERNING LAW This Sweepstakes shall be governed by California law. By participating in the Sweepstakes, entrants agree that California courts shall have exclusive jurisdiction over any dispute or litigation arising from or relating to this Sweepstakes and that venue shall be only in California. Organizing Sponsor reserves the right to modify the Official Rules of this Sweepstakes in any way or at any time. 13. WINNERS LIST: The winner’s name will be available after April 7th, 2007 and through April 30th, 2007.
